Every company is different. Every auditor is different.
Every legal team is different. What is put in place depends
on the client, industry, auditor, legal, situation, etc.
Companies will choose what to document and put in a policy
and procedure, and which items they choose their own risk
level based upon time, effort, criticality, exposure, etc.
License Agreement
By purchasing and downloading the IT Policies Examples
and/or the Disaster Recovery Plan Template, you
agree to the following: You are purchasing one (1)
non-transferable license for the use of the IT Policies
Examples and/or Disaster Recovery Plan Template at your organization. The license is granted solely
to you. You may not sell, lease or loan, or in ANY WAY
transfer the IT Policies Examples or the Disaster Recovery
Plan Template to any other organization.
Warranty
Except for the express warranties stated herein, the
Licensed Materials are provided on an "as is" basis, and
Licensor disclaims any and all other warranties, conditions,
or representations (express, implied, oral or written),
relating to the Licensed Materials or any part thereof,
including, without limitation, any and all implied
warranties of quality, performance, merchantability or
fitness for a particular purpose. Licensor further expressly
disclaims any warranty or representation to Authorized
Users, or to any third party. Licensor makes no warranty as
to the suitability of this product for any purpose. Every
company is different and applicability and/or use of these
examples vary by client, industry, situation, auditor, etc.
The IT Policies Examples and the Disaster Recovery Plan
Template are for your reference information
only. You must ensure its suitability and applicability,
compliance to any rules, regulations and/or LAWS. You should
have an attorney review any policies or procedures that you
plan to implement in your organization. Neither party shall
be liable for any indirect, special, incidental, punitive or
consequential damages, including but not limited to loss of
data, business interruption, or loss of profits, arising out
of the use of or the inability to use the Licensed
Materials.
Licensor makes no representation or warranty, and
expressly disclaims any liability with respect to the
content of any Licensed Materials, including but not limited
to errors or omissions contained therein, libel,
infringement of rights of publicity, privacy, trademark
rights, moral rights, or the disclosure of confidential
information.
Limitation of Liability
In no event will we be liable for (I) any incidental,
consequential, or indirect damages (including, but not
limited to, damage for loss of profits, business
interruption, loss of information, and similar) arise out of
the use of or inability to use the IT Policies Examples or
the Disaster Recovery Plan Template,
even if we have been advised of the possibility of such
damages, or (II) any claim attributable to errors,
omissions, or other inaccuracies in the materials. Because
some states do not allow the exclusion or limitation of
liability for consequential or incidental damages, the above
limitation may not apply to you. In such states, liability
is limited to the greatest extent permitted by law.
Indemnities
Each party shall indemnify and hold the other harmless for
any losses, claims, damages, awards, penalties, or injuries
incurred by any third party, including reasonable attorney's
fees, which arise from any alleged breach of such
indemnifying party's representations and warranties made
under this Agreement, provided that the indemnifying party
is promptly notified of any such claims. The indemnifying
party shall have the sole right to defend such claims at its
own expense. This indemnity shall survive the termination of
this Agreement.
Termination of Agreement
You may terminate this agreement by returning the materials
to us and destroying any and all other copies, hard copies
and soft copies. The provisions of this agreement shall
survive any termination of this Agreement.
Satisfaction Guarantee
If you are unhappy for any reason with the
downloaded IT Policies Examples or the Disaster Recovery
Plan Template within 30 days, you agree to destroy
all soft and hard copies of the IT Policies Examples and the
Disaster Recovery Plan Template and any
derivations of, for a full refund of the purchase price
minus any shipping costs (shipping costs only if
applicable). Refunds will only be credited back to the
original credit card used in the transaction. |
